The Independent National Electoral Commission (INEC) on Tuesday told the presidential election petition court that some documents asked by Mr Peter Obi and Labour Party (LP) are non-existence.
Obi and his Labour Party (LP) are petitioners in the petition marked CA/PEPC/03/2023 challenging the election which brought president Bola Tinubu into power
Respondents in the petition are the Independent National Electoral Commission (INEC) president Bola Tinubu and Vice president Kashim Shettima and the All Progressives Congress (APC.
The lead counsel of the petitioners, Livy Uzoukwu, SAN told the court that INEC brought some documents they asked for.
He said the petitioners INEC was subpoenaed in subpoena dated May 30 and June 13 to come and present some documents.
Mrs Olufunmilayo Attihiru, deputy Director, dept of certificate and compliance of the Commission presented INEC Manual for election officers.
She told the court that the other ones are big and comes from the states and would take some time.
However, she stated that the other was non-existent.
Mr Lawrence Bayode, deputy director ICT of the Commission told the court that out of the five documents the petitioners asked for, two are non-existent, one is work in progress.
He however, produced two of the documents.
Earlier, a subpoenaed witness , Loretta Ogah, (PW7) a cloud engineer and architect with Amazon Web Services incorporated (AWS) was taken in cross examination by the respondents counsel .
Being cross examined by Abubakar Mahmoud, counsel for INEC, the witness stated that different companies and agencies have different software development life cycle.
When asked when glitches supposed to appear?
” Glitches appear during the testing stage and not the production stage.
” It is highly unusual for glitches to occur for primary functions of applications in production “she said.
She said what she tendered had showed all the Amazons Web services (AWS) in all the regions .
She admitted that the cloud trial is not before the court.
Being cross examined by Wole Olanipakun, SAN , counsel for Tinubu and Shettima, the witness told the court that the documents she tendered were public.
She said she contested for house of representatives under labour Party in Cross Rivers and did not win.
She added that she sued INEC because it did not list her name in their portal because of network failure.
The witness said AWS services expressed outrage on several occasions.
Answering questions by Lateef Fagbemi, SAN for APC on whether she personally conducted the investigation on the application used by INEC, she said she did that on the IreV.
She said that the glitches did not occur on Feb. 25, 2023.
She however, said that she does not know the service level agreement between AWS and INEC, but she knows the general agreement.
The witness said she does not know INEC password protocol because she does not work there.
Meanwhile, the five-man panel led by Justice Haruna Tsammani later adjourned until Wednesday, 21et June 2023 for further hearing of the petition.
